Terms & Conditions

These internet servers are owned and operated by Novatrope, Inc. (herinafter Novatrope). Your agreement for internet services is strictly with Novatrope and no other party is authorized to mdofiy the following terms in any way.

Novatrope will supply network connectivity, voice service, text messaging, email accounts, and access to our compression server. You may resell any of these services to other customers, at prices that you shall solely determine. You must make these customers aware of the following “Acceptable Use Policy” and “Dislcaimer” and “UNLIMITED VOICE PLANS” Sections of this document. You agree to hold Novatrope harmless in any dispute arising from your failure to notify your customers of these policies. You are required to bill and collect from these customers and to provide technical support to them.

ACCEPTABLE USE POLICY

You may not use nor allow any of your customers to use any facilities, computers or servers of Novatrope for:

1. Any illegal act;
2. Any UNSOLICITED email or message sent to more than 15 recipients.

Violation of this ACCEPTABLE USE POLICY may result in termination of the offending account, or your entire account. In addition, there may be civil and criminal penalties for sending unsolicited emails. Any violation of the unsolicited email rules will result in immediate termination of the offending account. No refunds will be issued for unused portions of the service in that case.

UNLIMITED VOICE PLANS

UNLIMITED DOES NOT MEAN UNREASONABLE USE. UNLIMITED voice services are provided solely for live dialog between two individuals for personal use only. UNLIMITED voice services may not be used for telemarketing, call center services, conference calling, 3-way calling, call forwarding, monitoring services, data transmissions, transmission of broadcasts, transmission of recorded material, or other connections that do not consist of uninterrupted live dialog between two individuals for personal use. If Novatrope finds that you are using an UNLIMITED voice service offering for anything other than live dialog between two individuals for personal use, Novatrope may at its option terminate your service or change your plan to one with no UNLIMITED usage components. Novatrope will NOT provide notice that it intends to take any of the above actions. Novatrope may monitor or record the content of phone calls in order to determine compliance with these conditions.

CELL PHONE 911 SERVICE

All accounts which include telephone voice service also include 911 service. Calls to 911 are routed to an emergency service center, which will dispatch needed emergency services. Novatrope makes no guarantee that such services will be delivered, and will not be held responsilbe for any losses due to delays or failures of the 911 system.

Technical Support

Our technical support staff is available to assist you with any technical problems you may have. However, you are expected to handle technical support for your customers, and they should not be given our technical support number. Technical support is available toll-free at 1-800-364-6603 from 9:00AM to 6:00PM PT M-F.

DISCLAIMER

Novatrope, Inc. hereby disclaims any responsibility for damages resulting from lack of connectivity, including, but not limited to, loss of business from failure of web pages to serve, and losses resulting from undelivered email, both sent and received, as well as losses due to failed voice or text messages. We also disclaim any responsibility for and information your customers may receive over the internet. We provide connectivity to the the internet, which is a vast collection of networked computers all over the world. Some of these computers may contain material that is offensive or illegal in a variety of ways. You should advise your customers of these disclaimers.

Billing Policies

We will bill you at the end of each moth for customer accounts active during the month. Accounts opened or closed during the month will be prorated to the actual number of days in use.

Payment is due by the 15th of the month. If payments are not received on time, your accounts may be deactivated. You are responsible for payment of all accounts, regardless of whether you have received payment from your customer.
